These Terms and Conditions ("Terms") govern your use of the Marble Song voice answering service ("Service") operated by Marble Song ("we", "our", or "us"). By subscribing to or using the Service, you agree to be bound by these Terms.
Marble Song provides a phone answering service for small businesses. The Service answers inbound calls on behalf of subscribed business owners, collects caller information, and delivers the call information of each call to the business owner by email, to the addresses you select in your account settings. Your account settings also let you choose whether to be notified about calls on which the caller never spoke, and about calls the assistant flags as suspected spam. A call whose notifications you have switched off is still answered, still recorded in your call history, and still counts toward your included call minutes; only the email notification is withheld. You may also review call information through an online portal (the "Dashboard").
The Service operates in English only. Our automated assistant greets callers, converses, and asks questions in English, and call transcripts and summaries are produced in English. If a caller speaks a language other than English, the assistant may be unable to understand them, and the information captured from that call may be incomplete or inaccurate. Any greeting or always-ask questions you configure should be written in English; entering text in another language will not cause the assistant to conduct the call in that language. We do not currently offer the Service in any other language, and nothing in these Terms should be read as a commitment to add one.
As part of the Service, we assign you a telephone number (your "Service Number") that routes inbound calls to our automated assistant. Your subscription includes one Service Number. Your Service Number is acquired, owned, and controlled by Marble Song through our telephony provider and is made available to you only for use with the Service while your subscription is active. You do not own, and acquire no ownership rights in, your Service Number. You may not port, transfer, sell, or otherwise assign your Service Number, and you may not use it apart from the Service.
We may change or replace your Service Number if we need to — for example, if the number is blocked or flagged by carriers, or if our telephony provider requires the change. We will give you as much advance notice as is practical, though a change may occasionally need to happen quickly.
When your subscription is canceled, terminated, or lapses for any reason, your right to use the Service Number ends. You are not entitled to keep, port out, or continue using the Service Number after your subscription ends. We may hold the number for a limited period and then release or reassign it at our discretion. If having a dedicated business number that you own long-term is important to you, we recommend forwarding calls from a phone number you already own and control rather than publishing your Service Number as your primary business line.
The Service requires that calls reach your Service Number, which you accomplish by forwarding calls to it from a number you already own — either every call, or only the calls you do not answer. Call forwarding is a feature of your telephone carrier, not of the Service; we do not control it, and some plans restrict or exclude it. You are responsible for confirming that your carrier and plan support call forwarding, for configuring it, for testing that it works, and for re-establishing it after any event that clears it — including SIM changes, number transfers, plan changes, or carrier-side account changes. Forwarded calls may count against your plan's minutes or incur charges from your carrier; those charges are yours.
Each inbound call handled by the Service is subject to a maximum duration of four (4) minutes. As a call approaches this limit, the automated assistant will attempt to wrap up the conversation, and the call will be automatically disconnected at approximately the four-minute mark. This limit applies to every call. The Service is intended to capture a caller's request and callback details, not to conduct extended conversations.
You must be at least 18 years of age and operating a legitimate business to subscribe to the Service. By creating an account, you represent and warrant that you meet these requirements.
Access to the Service is provided on a monthly subscription basis. Your subscription has two parts: a flat monthly base fee that includes a set number of call minutes, and a usage charge for call time beyond that included amount. Call time is measured in seconds, from when the Service answers a call until the call ends, and is not rounded up to the next minute; call time beyond the included amount is charged per second at the per-minute rate. Calls identified as suspected spam or robocalls count toward your call time like any other call. Current amounts are shown on our pricing page.
The base fee is billed in advance at the start of each billing cycle. Usage charges are billed in arrears: call time during a billing cycle is totaled when that cycle closes and appears on your next invoice, together with the base fee for the upcoming cycle. If your subscription ends for any reason, any usage charges you have accrued but not yet been billed for will appear on a final invoice. All fees are non-refundable except where required by law. We reserve the right to change subscription pricing with at least 30 days notice to active subscribers.
You agree to use the Service only for lawful business purposes. You may not use the Service to:
The Service answers, records, transcribes, and summarizes inbound calls. At the start of every call, before any greeting you have configured, our automated assistant plays a fixed disclosure informing the caller that the call will be recorded and transcribed and that they are speaking with an automated assistant. This disclosure is built into the Service, plays on every call, and cannot be edited, shortened, reordered, or removed by you or by any custom greeting you configure. The disclosure is played in English.
You agree not to misrepresent the Service to callers, not to hold the automated assistant out as a live person, and not to use the Service in any manner that circumvents or undermines the disclosure described above. You remain responsible for compliance obligations we cannot meet on your behalf, including any additional notice, consent, or recordkeeping requirements that apply to your particular industry or profession, any requirements arising from how or where you publish your Service Number, and your handling of caller information after we deliver it to you. If your business is subject to requirements that the standard disclosure does not satisfy, the Service may not be appropriate for your use. Marble Song is not liable for any failure on your part to meet the obligations described in this Section.
Recordings are retained for a limited period and transcripts are retained as described in our Privacy Policy.
We send call summaries, one-time sign-in codes, and account, billing, and service notices by email to the addresses on your account. We do not send SMS text messages as part of the Service. If you provide a phone number, we may use it to contact you about your account or to help with setup and support. Any charges your telephone carrier applies to forwarded calls are described in Section 2.
Our collection and use of information is governed by our Privacy Policy, which is incorporated into these Terms by reference. You are responsible for handling any caller data you receive through the Service in accordance with applicable privacy laws.
We strive to maintain consistent Service availability but do not guarantee uninterrupted or error-free access. The Service depends on a number of third-party providers, including our telephony, voice-AI, hosting, email, and other infrastructure and communications providers. We are not liable for outages, delays, or disruptions caused by any such provider or by circumstances beyond our reasonable control.
Because the Service depends on these providers and on the availability of telephone and internet networks, the Service may be unavailable or interrupted from time to time. During any period of unavailability or interruption, inbound calls may not be answered, recorded, transcribed, summarized, or delivered to you. You are responsible for maintaining any alternative means of receiving calls that your business requires, and you should not rely on the Service as your sole means of answering inbound calls.
To the fullest extent permitted by law, Marble Song shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including but not limited to lost revenue, missed calls, or business interruption. Our total liability to you for any claim arising from the Service shall not exceed the amount you paid us in the 30 days preceding the claim.
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be error-free, that call information will be accurate or complete, or that the Service will meet your specific business requirements.
Either party may terminate the subscription at any time. Upon termination, your access to the Service will cease at the end of the current billing period. Upon termination, your access to the Dashboard will also be suspended. We reserve the right to suspend or terminate accounts that violate these Terms without notice or refund.
We may update these Terms from time to time. We will notify active subscribers of material changes via email at least 14 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
These Terms are governed by the laws of the State of Georgia, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts of Georgia.
